In conjunction with the General Terms and Conditions, the following apply to any subscription you make to the HardSexToys.com program.

Program Levels

The Program contains three levels. Your application should indicate the level at which you wish your application to be considered. the Program levels are:

1) Affiliate – standard affiliate program. Applications are open to anyone. No branding of our site will be offered. There are no restrictions or minimum sales requirements at this level.

Links to our site may be subject to review and approval by us. If requested to change or remove a link, you agree to do so immediately.

Links and/or Banners not provided by us may not be used for promotion of our site and will result in termination of your Program participation and the forfeiture of any commissions outstanding.

2) Tier 1 Partner – we will offer a version of our store which is presented as co-branded website using a colour palette and logo suitable to match your brand or own website. The address to the site will start with your chosen name, but will end with the original website address. Secure pages will incorporate the original branding and site address for security and the customer’s peace of mind when making purchases.

Qualification for Tier 1 requires that you maintain an average of at least £1000 per calendar month in sales.

3) Tier 2 Partner – we will offer a branded website using a colour palette, logo, pictures and welcome text to suite your branding or own website. The address of the site will be customised to match your branding or site and we will provide a secure certificate and other technical means to provide a secure purchasing experience for the customer.

Acceptance for Tier 2 will incur an annual fee of £200 and require that you maintain an average of at least £2000 per calendar month in sales. The annual fee will be waived for any partner exceeding an average of £5000 per month.

Fee Schedule

You will earn commission based on the sales price of the goods or services, not including costs for shipping and handling, and less any applicable taxes. The sales price means the sale price of the product as listed on the site at the time of purchase.

The fee schedule for this agreement is:

• 5% of the sale price on eligible items for sales up to £500 per month.
• 8% of the sale price on eligible items for sales over £500 per month.

Individual items where the sale price is over £200 shall be limited to no more than 5% commission regardless of the sales volume in that month.

When deducting shipping and handling costs, this will be the actual cost of shipping to the customer and may be greater than the shipping and handling cost charged to the customer at the time of purchase.

Returns, chargebacks or other fees will be deducted from the month end totals.

Program Termination

For Affiliate or Tier 1 Partners - this agreement may be terminated at any time by either party by supplying at least 30 days written notice but will otherwise renew automatically on each anniversary.

For Tier 2 Partners – this agreement may be terminated by providing 30 days’ notice except under the following circumstance:

• the annual fee has been waived by us
• less than six months has elapsed since the annual fee became due

Under these circumstances, the agreement may only be terminated upon payment of the annual fee in full.
